Project Occupational Health and Safety (OHS) Committee

1. Objective

To set up Occupational Health and Safety (OHS) committee among Company, following Iranian labor law, article 93.

2. Background

OHS committee shall be set up in Company ASAP according to newly added article to the labor law (Article 93).

3. Work Scope

Below is the translation and work scope according to article 93 of labor law:

The main role of OHS committee is to identify hazardous critical points and set control measures to control the risk levels to as low as reasonably practicable (ALARP).

Clause 1: The purpose of organizing OHS committee is to enable the workers and company to take part in implementation of OHS management system and to ensure the protection of human resources and assets and prevention of occupational illness take place in right manner.

Clause 2: In any working site with 25 staff and more, the company is required to establish OHS committee contains below positions:

· Company Rep.

· Employee's Rep.

· Technical Manager.

· Safety Head.

· Occupational Health Head.

Note1: Head of occupational health is preferred to be graduated in occupational health category or be a medic doctor.

Note2: All committee members shall participate in training courses in related govemental organization (labor office).

Note3: In those sites having 25 to 100 staff, if 1 or 2 of the committee members are not available, the meeting can be held by 3 persons but head of occupational health shall be present.

Note4: Competency of head of safety and head of occupational health shall be examined and approved by labor office.

Note5: OHS committee shall hold meeting at least once a month, and committee secretary shall be assigned among the members and shall record the MOM and actions to be taken.

Note6: In case of urgent issue, the meeting of committee will be held earlier than 1 month interval.

Note7: In case the OHS committee suspects the occurrence of an incident with regard to occupational illness, committee shall hold the meeting immediately and inform the company, labor office and govemental health organization about the result.

Note8: Company shall submit the MOM and decisions taken in each meeting to labor office and govemental health organization.

Clause 3: Roles and responsibilities of OHS committee

1. Raise the OHS non conformities related to the work activities and set required remedial action plan.
2. Inform to company about any OHS difficulties.
3. Coordinate and cooperate with labor office inspector to implement OHS work regulations.
4. Set plan to familiarize the workers with OHS regulations and requirement.
5. Support the company to create required OHS documentation for safe and healthy work practices.
6. Set intensive scheme system and company to give bonus to those labors follow OHS regulations.
7. Prepare MOM, incident report and occupational illness report and send to relevant govemental organizations.
8. Follow up per-employment and annual medical checkup and issue the result to govemental health center for record.
9. Inform any suspicious element or cause for suspicious occupational illness to govemental health organization and Assist Company to change the occupation of those staff who may not be fit to some the works (Article 92 of work law, clause 1).
10. Gather OHS statistics and fill out the form of work site non conformities.
11. Visit the work locations and inspect all working tools and make sure the correct usage of the tools and equipment.
12. Record OHS accident statistics and figure out the frequency rate and severity rate of the accident on yearly basis.
13. Monitoring on preparation of accident graph and post OHS training pamphlet onto the work sites.
14. Identify and announce hazardous critical points of the work sites.
15. Inspect and control of material management, housekeeping and ensure correct usage of the materials and safe storage.
16. Provision of clear OHS Policy based on work law and according to the work site requirement.
17. Provision of all set of HSE MS documentation in terms of physical, chemical, ergonomic, biologic and psychological aspect of the work effects on the task forces.

Note: Since all OHS members shall participate in labor office training course and to be issued by necessary certificates, there may be some difficulties for non-Iranian staff to be part of the list, but they can take part in the sessions.

4. Budget

Below courses (as minimum requirement) shall be organized for all committee members (Clause 17 of Article 93 of labor law)

5. Recommendation

To prevent any legal claim by labor office against Company, it is recommended to let OHS committee established and starts working as the first step.
